9. Whether the Hon’ble High Court has not ignored to consider that right to equality provides no discrimination between man and woman when woman is putting wrong allegations on man in order to get unfair maintenance from the man and man is striving to full his liabilities at the best.

In Citation of Bisheshwar Nath V. IT Commissioner, AIR 1959 SC 149, it was held by the Supreme Court of India that the rights under Article 14 of Indian Constitution can not be waived. Thus, no citizen of India can waive his fundamental rights. It is not a mere privilege or license granted by the Constitution. A person can waive his ordinary right but the fundamental rights can not be waived.
