Q: Explain the pertinency of maintenance of wife ?

Ans: According to section 125 of Cr.P.C, both girl and boy are eligible to get the maintenance from his/ her parents till 18 years of age. 

There is no discrimination between boy and girl under section 125 of Cr.P.C.

But according to section 20(3) of Hindu adoption and maintenance act, 1956, there is no age for girl to get maintenance from her father if she is unmarried and not able to earn. After marriage,  it would be the responsibility of husband to look after her and she would get maintenance from her husband if she is not able to earn. But after the death of father and husband, a girl can not put litigation against her brother, sister and anyone for maintenance whether she is unable to earn. So, it will not be a the right approach to provide maintenance to wife if she is educated and can do the job.  It is against the law of nature and the objective law can not be to make someone cripple and dependent.
