Q: Discuss Maintenance under Cr.P.C?

Ans: Under Section 125 of Code of Criminal Procedure, 1973, the order for maintenance of wives, children and parents are mentioned.

According to section 125 of Code of Criminal Procedure,  the wife, divorced wife and parents can claim maintenance from Husband.

The amount of maintenance will be given according to discretionary power of court under section 125 of Code of Criminal Procedure, 1973.

The maintenance will be given to wife according to status of husband.

The wife can also claim maintenance in the conditions of both physical cruelty and mental cruelty.

As per section 125(1)(d), the wife can claim maintenance from father in law as well.

To get fast maintenance, interim maintenance will be demanded under section 125(3) of Cr.P.C.

The wife can get interim maintenance within 60 to 90 days.
