Ans: In this citation, the judgement was that we were fully convinced that the marriage between the parties has irretrievably broken down because of incompatibility of temperament. In fact, there has been total disappearance of emotional substratum in the marriage. The matrimonial bond between the parties beyond repair and that the marriage has been wrecked beyond the hope of salvage and therefore public interest and interest of all concerned lies in the of the recognition of the fact and to declare defunct de jure what is already defunct de facto.”

Ans: During a case of Supreme Court of Rohtash Singh Vs Smt. Ramendrei & Ors. on 02-03-2000, it was held that  Wife is not entitled to maintenance who deserted her husband. The Hon’ble Supreme Court held that under this provision, a wife is not entitled to any Maintenance relief from her husband if she is living in adultery or if she has denies to live with her husband without any sufficient cause or if the couple is living separately by mutual consent.
