Ans: In Gollins v Gollins, (1963) 2 All ER 966, the question arose as to whether the husband would be held guilty of cruelty when he was not deliberately treating the wife with cruelty and in fact was oblivious of the consequences of his actions upon his spouse. It was held:
"An intention on the part of one spouse to injure the other is not a necessary element of cruelty as a matrimonial offence, though the presence of such an intention if it exists, is material and may be crucial."
